1. Eligibility

Anyone with a Google or Apple account is elligible to access Digitank.

2. Your Account

You are responsible for maintaining the confidentiality of your account and for activities under your account. You agree to provide accurate information and keep it updated.

3. Your Content (Photos and Uploads)

• You retain ownership of content you upload (e.g., fish photos).
• By uploading content, you grant us a limited license to host, store, process, and display that content solely to operate the App (e.g., AI recognition and showing your tank).
• You confirm you have the rights to upload the content and that it does not violate any law or anyone else's rights.

4. Acceptable Use

You agree not to:

• Upload illegal content or content that infringes rights
• Attempt to hack, disrupt, scrape, reverse engineer, or abuse the App
• Use the App to harass, deceive, or harm others

5. AI Estimates Disclaimer

Digitank provides estimates of species, length, and weight based on images and may be inaccurate. Do not rely on the App for safety-critical, legal, or regulatory decisions.

6. Modifications and Availability

We may update, change, or discontinue parts of the App at any time. We do not guarantee uninterrupted availability.

7. Termination

We may suspend or terminate access if you violate these Terms or if needed to protect the App, users, or legal compliance. You may stop using the App at any time.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or loss of data, profits, or goodwill arising from your use of the App.

9. Indemnification

You agree to defend and indemnify us from claims arising out of your content, your misuse of the App, or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law rules.
